[Transport] Judge Forbids Elimination of SEPTA Transfers

On Thursday, Pennsylvania Common Pleas Court Judge
Gary F. DiVito, Jr. ruled that the Southeastern
Pennsylvania Transportation Authority (SEPTA), which
operates the public transit system in the Philadelphia
Metro Area, cannot eliminate paper transfers as the
transit agency had proposed. The Judge said that
SEPTA's decision to eliminate transfers was
"capricious and . . . a manifest and flagrant abuse of
discretion."

In his ruling, he further said, "What the evidence
demonstrates is that SEPTA's board (1) voted to
eliminate paper transfers (2) to mollify the
legislature in hopes of ensuring funding (3) without
any study of the impact on those who would be most
adversely affected (4) without any semblance of a
'modernization plan' ready (5) with no agreement with
the school board in place when (6) they could have
designed a plan with an equitable impact on all of its
riders."

DEPTA officials vowed to appeal this order to
Pennsylvania Commonwealth Court. However, until such
time that a higher court overturns the lower court's
ruling, paper transfers will still be in use on all
SEPTA trains, trolleys, and buses.
